इलाहाबाद हाईकोर्ट ने कांग्रेस सांसद और लोकसभा में नेता प्रतिपक्ष राहुल गांधी को कड़ी फटकार लगाई है। यह फटकार भारतीय सेना पर कथित अपमानजनक टिप्पणी के लिए दी गई है, जो उन्होंने भारत जोड़ो यात्रा के दौरान कही थी।

हाईकोर्ट की सिंगल बेंच ने साफ किया कि:
“भारतीय संविधान का अनुच्छेद 19(1)(A) भले ही भाषण और अभिव्यक्ति की आजादी देता है, लेकिन यह आजादी उचित प्रतिबंधों के अधीन होती है।”
न्यायमूर्ति सुभाष विद्यार्थी ने कहा कि यह स्वतंत्रता किसी को भारतीय सेना के खिलाफ अपमानजनक बयान देने की छूट नहीं देती।

राहुल गांधी ने इस मामले में निचली अदालत के समन को चुनौती दी थी, लेकिन हाईकोर्ट ने उनकी याचिका खारिज कर दी। कोर्ट ने कहा कि:
- राहुल गांधी के पास सत्र न्यायालय में अपील करने का विकल्प है।
- शिकायत और गवाहों के बयानों से प्रथम दृष्टया मामला बनता है।

यह मामला उदय शंकर श्रीवास्तव की शिकायत पर आधारित है। उन्होंने आरोप लगाया कि राहुल गांधी ने अपनी यात्रा के दौरान भारतीय सेना के खिलाफ आपत्तिजनक टिप्पणी की थी।
राहुल गांधी के वकील ने इस याचिका को राजनीति से प्रेरित बताया और कहा कि इसमें कोई दम नहीं है। वहीं, सरकार की ओर से कहा गया कि गांधी की याचिका स्वीकार्य नहीं है।

भारत का संविधान सभी नागरिकों को अभिव्यक्ति की आजादी देता है, लेकिन जब यह आजादी राष्ट्रहित, शांति व्यवस्था या प्रतिष्ठित संस्थाओं के सम्मान से टकराने लगे, तो कानूनी कार्रवाई संभव है।
राहुल गांधी पर कोर्ट की यह टिप्पणी केवल एक राजनेता की जिम्मेदारी नहीं, बल्कि अभिव्यक्ति की सीमाओं को लेकर एक बड़ी नसीहत है। चाहे कोई भी नेता हो, सेना जैसी संस्थाओं के सम्मान को लेकर बयान देने से पहले सोच-समझकर बोलना ज़रूरी है।
